Frequently asked questions

Answers to the questions clients ask most often

We handle contract disputes, debt recovery and damages claims, corporate disputes, bankruptcy cases and disputes over the enforcement of court decisions. We represent companies and sole proprietors in Ukrainian commercial courts of first instance, appeal and cassation.

As a general rule, pre-trial settlement is not mandatory in Ukraine, but in certain cases it is required by law or by the contract. Even where it is optional, a claim letter often secures payment without litigation or puts the parties’ positions on record. We assess whether a claim letter makes sense in your case, draft it and respond to claims from counterparties.

Depending on the contract terms and the circumstances, you may claim penalties, fines, inflation losses and 3% per annum on top of the principal debt, as well as compensation of damages. During the consultation we review the contract and documents and identify which claims have good prospects.

Ukrainian procedural law provides for interim measures to secure a claim, such as an attachment of the defendant’s property or funds. We prepare well-grounded applications, since the court grants them only where the statutory grounds are met.

Yes. We handle disputes between members, challenges to general meeting resolutions, member withdrawal and payment of the value of the share, and we protect clients against an unlawful change of owner or director. To reduce the risk of such conflicts, we help prepare the charter and shareholder agreement.

In a bankruptcy case, a creditor must lodge its monetary claims against the debtor within the statutory deadline. We represent creditors under the Code of Ukraine on Bankruptcy Procedures: we lodge claims, take part in the creditors’ meeting and committee, and challenge the debtor’s transactions. We also protect the interests of debtors.

We support enforcement proceedings with state and private enforcement officers, monitor their actions and, where necessary, challenge their actions or omissions. Our work covers the full cycle — from the claim letter to actual enforcement of the court decision.

You receive a legal assessment of your specific situation, a step-by-step action plan, an understanding of the real cost of resolving the matter and advice on which steps you can take yourself, without unnecessary expense.
